CGV-2025-03 — TERMS OF SALE

1. Purpose

These Terms of Sale (“Terms”) govern all services provided by Erysan, the trade name of the sole proprietorship of Guillem BLASCO, to any client (“the Client”) who places an order online or by electronic communication.

Any order implies full and unconditional acceptance of these Terms.

2. Nature of the Services

Erysan provides personalized intellectual services, including:

  • personalized diagnostic reports,
  • contextual analysis of personal or professional situations,
  • decision-making support,
  • organizational assistance,
  • non-representative administrative assistance,
  • research of resources and information,
  • drafting assistance,
  • non-contractual suggestions for external professionals.

These services:

  • are advisory and analytical in nature,
  • do not constitute regulated professional services,
  • do not replace medical, psychological, legal, fiscal, or accounting advice,
  • do not constitute emergency assistance.

3. Prices

3.1. Diagnostic Report – Fixed-price service

  • Price: “from €120”, all taxes included (VAT not applicable – Article 293B of the French General Tax Code).
  • The final price may vary depending on the complexity of the Client’s situation.
  • The applicable price is the one displayed at the time of purchase.

3.2. Customized Support – Quotation-based service

  • The Client submits a detailed request via the contact form or email.
  • A personalized quotation is sent by email.
  • The quotation specifies the nature of the service, the total price, the indicative timeline, and any specific terms.
  • The service begins only after written acceptance of the quotation by the Client.

4. Orders

4.1. Online Orders (Diagnostic Report)

The Client selects the service and proceeds to secure payment.
Payment constitutes a firm and final order.

4.2. Orders Based on Quotation

The written acceptance of the quotation constitutes a binding agreement between the Client and Erysan.

5. Waiver of the Right of Withdrawal

(Article L221-28 of the French Consumer Code)

The Client expressly acknowledges that:

  1. The service is entirely personalized.
  2. The execution of the service begins immediately upon Client request, before the end of the statutory withdrawal period.
  3. As a result, the Client waives their right of withdrawal in accordance with Article L221-28(3) of the French Consumer Code.
  4. No withdrawal or cancellation is possible once the service has begun.

A specific checkbox confirming this waiver is required at the time of purchase or acceptance of a quotation.

6. No Refund Policy

Due to:

  • the personalized nature of the service,
  • the explicit waiver of the right of withdrawal,
  • the immediate start of execution upon request,

no refund, full or partial, will be issued once the order is confirmed.

7. Client Obligations

The Client agrees to:

  • provide accurate, complete, and truthful information,
  • respond precisely to questions required for the service,
  • inform Erysan of any significant change in their situation,
  • assume full responsibility for the use of the delivered analysis.

Any omission, inaccuracy, or misrepresentation is the sole responsibility of the Client.

8. Erysan’s Obligations

Erysan agrees to:

  • analyze the information provided with diligence,
  • deliver a personalized analysis in accordance with the purchased service,
  • inform the Client when the situation falls outside Erysan’s scope,
  • redirect the Client to competent professionals if needed.

Erysan is bound by a best-effort obligation, not an obligation of result.

9. Timelines

Timelines indicated on the Website or in quotations are indicative only.
Delays shall not give rise to cancellation, compensation, penalties, or refund.

10. Limitation of Liability

Erysan cannot be held liable for:

  • decisions made by the Client based on the analysis,
  • misuse of the information provided,
  • technical failures or interruptions,
  • omissions or inaccuracies in the information submitted by the Client,
  • actions or omissions of external professionals suggested to the Client.

The Client remains solely responsible for their decisions.

11. Contract Termination

In case of breach by the Client of any obligation under these Terms, Erysan may terminate the contract without refund and without prejudice to any sums due.

12. Personal Data

Personal data is processed in accordance with the Privacy Policy (RGPD-2025-04).

13. Governing Law

These Terms are governed by French law.
Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the French courts in the district of the operator’s registered office.
